TERMS & CONDITIONS

Booking with Can Properties Noosa you agree to be bound by the following Terms & Conditions. Can Properties Noosa reserve the right to alter, cancel or change any of these Terms and Conditions as a result of changes in the holiday market, changes in Legislation or the requirements of property owners or a Body Corporate at any time without notice. Due to circumstances beyond the control of Can Properties Noosa that would affect this reservation (such as flood, fire. Act of God), the property is sold, withdrawn from letting or become unavailable for another reason prior to this reservation commencing Can Properties Noosa will endeavour to find alternate accommodation at a similar tariff. Can Properties Noosa cannot be held responsible for the actions taken by the owner or third party for unforeseen events occurring beyond our control.



Tariffs:

Tariffs are current as per the tariff sheet, brochure, and website, and are subject to change without notice. No responsibility is accepted for errors and omissions contained on this website, holiday accommodation brochure or tariff sheet.


Reservation:

If you are booking outside 6 months you are required to pay an initial holding deposit of 10% of the tariff or $500.00 + Booking Fee non-refundable booking fee whichever is the greater within 48 hours, if the holding deposit is not paid your booking will be automatically cancelled.


The balance of the deposit which must equal 50% of the tariff is payable 6 months prior to your arrival. If the deposit is not paid by the due date your booking will be automatically cancelled.


Payment in full of all tariffs & charges must be paid 7 days prior to your arrival. If your arrival date is between 18 December and 07 January, the full tariff must be received no later than one month (30 days) prior to the arrival date.


You’re completed & signed Guest Registration Form and Privacy Act Form must be returned prior to your arrival. Keys and or remotes will not be issued unless payment is made in full or prior arrangements have been made with management.



Payments:

Guests wishing to pay monies with a credit card (VC or MC) will incur a surcharge of 2% (subject to change without notice). When paying by Direct Deposit please ensure the booking surname/or invoice number as a reference. Personal cheques will not be accepted within 10 days prior to arrival. Personal cheques that are dishonoured you will incur the dishonoured fee.


If your arrival date is between 18 December and 07 January, the full tariff must be received no later than one month (30 days) prior to the arrival date. Failure to pay the full tariff by this date may result in your booking being cancelled and forfeiture of any deposits already paid unless the property is re-let for the period of the cancelled booking. In this case the administration fee of $300.00 will be retained plus the non-refundable booking fee.


 

Cancellations:

In the event of a guest cancelling for any reasons whatsoever within 30 days of your arrival; it is the condition that no refund of the deposit shall be made unless or until the property is re-booked for the same dates & tariffs. If the property has been re-booked the guests deposit will be refunded less a cancellation fee of $300.00 plus the non-refundable booking fee.


In the event of a guest cancelling given more than 30 days the deposit will be refunded less an admin fee of $300.00. Note the initial booking fee is non-refundable. All refunds are paid via bank transfer.


A notification of cancellation of a confirmed booking must be made in writing, either by email to carolanne@canpropertiesnoosa.com.au or by letter, addressed to Can Properties Noosa, Po Box 290, Noosaville Qld 4566



Change of Property/Dates

a) For a change of accommodation dates, more than 3 months prior to arrival a $55 incl. GST administration fee will apply and subject to availability.

b) For a change of property, less than 3 months prior to arrival, Cancellation clause applies.

c) No fee will apply to extend the dates of your holiday booking; however, this is subject to availability.


Arrival & Departure:

Check In: 14:00

Departure: 10:00

Check-ins: Instructions will be emailed to you prior to arrival


Should you require an earlier check in or later check out please contact our office. Please note that extra charges may apply.


Guests are responsible to ensure all belongings are removed from the property at the time of departure. Any items left behind in the property the Guest is to arrange at their expense for the items returned within 7 days


To ensure that no extra cleaning fees will apply the following must be done:


All rubbish to be removed from the property and placed in the appropriate bins (yellow lid for bottles/papers/cardboard only) and excess rubbish must be taken away, otherwise charges will apply.

Dishwasher must be emptied, all dishes washed properly, dried and put away.

The property must be left secure with all windows and doors closed and locked and turn off any air conditioners

The furniture must be placed back in its original position.

BBQ must be cleaned, otherwise a fee will apply

Pet Friendly properties make sure all dog faeces, bones & bowls are cleaned up and removed, otherwise a fee will apply

Please leave the premises clean and tidy as an additional cleaning fee may be charged.

All keys and or garage/gate remotes must be left at the property on departure unless advised otherwise with instructions. Failure to return keys will incur a fee to cover the cost of recovering the keys, totalling $50.00.


Call Out Fee:

Ensure you have your keys and or remote with you before leaving your accommodation. A call out fee of $100.00 will apply if a staff member is required after hours. The call out fee will automatically be deducted from your credit card. Phone 0448 360 544 after hours.


Linen & Cleaning Charges:

Properties that are supplied with linen will receive a linen change mid-week for stays 10 days or longer, please check with our office to see if your booking provides this service. Guests can arrange for full service cleans at their cost. Any linen that has been damaged or stained costs for replacements will be deducted from the guest’s credit card.


Please leave the premises clean & tidy with all rubbish removed as any additional cleaning fees will be charged.


Amenities in the properties are complimentary only and not replenished during your stay


Breakdown of Equipment:

Air Conditioners, Swimming Pools and electrical appliances are subject to break down and sometimes, delayed repairs. Please report any breakdowns as soon as possible. Whilst every effort will be made to repair these items as quickly as possible, no guarantee of their availability or serviceability for the duration of a stay is given. NO Refund or reduction in tariff will be made for non-availability of any of these items for any part of your stay.


Damages:

The Guest will agree upon request any and all reasonable charges resulting from damage or loss to the property or its effects and inclusions which results from any actions or neglect by the guest and or member of their party other than may be considered fair wear & tear through reasonable use of the property under the terms of letting. The Guest will agree for Can Properties Noosa to deduct any monies owed for damages from the guest’s credit card details.


 

Smoking:

In accordance with State Legislation, smoking is STRICTLY PROHIBITED inside any Holiday Rental Property. If guests or their invitees have been smoking inside the premises, costs associated with the cleansing of the property to remove all traces of cigarette smoke will be charged to the guest. This can include dry cleaning of all soft furnishings, drapes/curtains & carpets. Some properties allow smoking outside the premises, but smoking must only occur more than 3 metres away from the doorway of any property and all butts must be disposed correctly.


Functions & Gatherings:

The property is be used strictly for holiday purposes by the guest(s) and the number of occupants nominated on the Guest Registration Form. The use of the property for a function, party or gatherings is STRICTLY PROHIBITED.


Your reservation will be immediately terminated

The Guest(s) and other occupants of the property will vacate immediately

A $4000.00 penalty fee will apply if the number of guests exceeds the number of guests advised on the guest registration form, to compensate for any extra cleaning & damage to the property.


Termination:

If your reservation of the property is terminated Can Properties Noosa and/or the Owner of the property is authorised to carry out removal via any methods necessary at the guest’s cost. If your reservation of the property is terminated and you are removed from the property, the total tariff paid for your reservation will be forfeited to the Owner of the property. There will be no refund of tariff.


Keys/Remotes:

All keys/garage/gate remotes must be returned to our office upon departure. Two sets of keys are available to guests on arrival. Lost or damaged keys or remote controls will incur a recutting or replacement charge and will incur a locksmith’s fee to replace any locks. Keys will not be provided if a balance of the tariff has not been paid.


Telephones, Television, and Internet Access:

Noosa and surrounding areas do have network coverage issues due to our terrain. Can Properties Noosa offer no guarantee that the quality of mobile phone reception, internet access and television at any property to be high coverage. Not all properties have telephone/internet facilities: if these facilities are important to you, please confirm their availability with our office prior to arrival.


 

Future Reservations

Reservations do not automatically repeat. If you wish to request the same property for the same period, the following year you must make that reservation within the first week of arrival. Bookings may be made up to 54 weeks in advance – it is advisable to request your booking period either in person, online or by telephone as soon as you are able. As bookings may be made by guests online or via 3rd parties (co-let agents, owners etc) we cannot guarantee future booking availability. Usual reservations arrangements and conditions apply including a holding deposit payment of 10% of the tariff or $500 plus the non-refundable booking fee, whichever is the greater within 48 hours.


Maintenance:

Please report any maintenance/breakdown of equipment as soon as you can. Can Properties Noosa will make every effort for any repairs to air conditioners, swimming pools & electrical appliances as quickly as possible however we offer no guarantee of their availability or serviceability during your stay. No refund or reduction in tariff will be made for non-availability of any of these items for any part of a stay.


Animals:

NO animals or birds are permitted in units as it is against the Body Corporate Regulations. Pets are not permitted on the premise unless the property is designated ‘Pet friendly’ a Pet Fee of $100 applies. Pets reported and/or discovered on the property and found to be in the control of guests or associated people will render the guests liable for extra changes and risk immediate eviction and forfeiture of any unused tariff. Pets are to be kept STRICTLY OUTSIDE and the guest(s) will be responsible for any damages. Upon departure of these properties all dog droppings must be removed from the premise and disposed of properly. If this does not occur a clean-up fee will be charged.


Body Corporate By-Laws:

All guests and/or visitors will comply with any Body Corporate By-Laws and house rules, which may include sharing your contact details with a 3rd party. The guests and/or visitors will not create or permit any noise or other nuisance within the premises or common areas. Failure to comply with Body Corporate By-Laws may result in the termination of your booking. By-Law Breaches result in fines from the Body Corporate which will be passed onto the guest(s).

 


Building Works & Noise:

Can Properties Noosa will not be held responsible for works that cause disturbances or inconveniences associated with building/renovations being carried out in a complex or in the vicinity of your holiday accommodation. It is the individual owners and or Body Corporate’s responsibility to notify us of any such refurbishment/renovation as Can Properties Noosa is not always aware of these works.


Security Deposits

a) A valid Credit card details will be utilized as a security bond.

b) All credit card details will be destroyed after final inspection of the property if no claims are to be made.

c) Can Properties Noosa reserve the right to make claims on the security bond if the terms & conditions are not met, resulting in loss, extra cleaning, damage, expense of inconvenience.

d) Guests will be notified on claims being made prior to any payments being debited.

e) A guest registration form is required to be completed by the guest for all bookings. The registration form requests details of you name, address, driver licence number as well as credit card details. If credit card details cannot be supplied a $500.00 or 10% of the booking (whichever is greater) cash security deposit is required. This will be returned to guests within 14 days of vacating after satisfactory property inspection, via direct deposit. An increased security deposit may be incurred at our discretion.


Insurance:

Due to any unforeseen circumstances including loss of deposit, cancellation fees, medical expenses, loss of personal property and cancellation of airline flights we recommend you purchase travel insurance.


Left items:

If requested we will endeavour to recover and return items inadvertently left in a holiday property, but we take no responsibility for the recovery or return of these items. Postage and packaging and the cost of sending out a staff member to search for the item will need to be paid in advance, a minimum cost of $27.50 incl. GST applies, this is at the guest’s expense. Low value items will be held for claiming, if returned to our office, for a maximum of 2 weeks and if not claimed will be disposed of.


Inappropriate bookings or Schoolies Week:

Can Properties Noosa reserve the right to refuse any booking that they feel may be inappropriate or that falls across the period of Schoolies Weeks.



Bad Books

Can Properties Noosa participates in the Bad Books register. By accepting this booking and our Terms and Conditions you hereby agree that if you or any occupant covered by this booking, including any guests, breach our Terms and Conditions then your Name, Phone Number and Email address along with details of the breach/breaches may be disclosed to the property landlord and/or other agents participating in the Bad Books register. CAN Properties Noosa reserves the right to cancel a booking where a guest is registered in Bad Books.

With regard to telephone, postal, or email bookings. We will always attempt to accurately describe a property and its facilities. Experience shows that some confusion/misinterpretation is always possible. Therefore, no responsibility is accepted for errors and omissions contained in any communications, this website or holiday brochure. Can Properties Noosa cannot accept any liability for any misconception as to the features and quality of the property.


Ending an Agreement:

Can Properties Noosa reserve the right to inspect the property at any time during the reservation without notice if notified that the guest(s) are in breach of the terms and conditions of their occupancy.


Noosa Council | Code of Conduct:

Vehicles to be stored to not cause a nuisance or inconvenience to adjoining premises, and be parked within parking facilities on the premises where provided.

Use of the premises, including any outdoor area of the premises, for example, an outdoor entertainment area, deck, balcony, swimming pool or spa, must not—detrimentally affect the residential amenity (including but not limited to noise, overlooking or light spill) enjoyed by residents adjoining or in the vicinity of the premises; or

 cause a nuisance (including a noise nuisance); or

display unacceptable behaviour (for example loud aggressive behaviour; yelling, screaming, arguing; excessively loud cheering, clapping or singing; or create a level of noise which is in excess of the acceptable levels described by Queensland Government legislation for environmental protection (noise).

An occupant of the premises must not sleep or camp on the premises in a tent, caravan, campervan or similar facility.


Pets occupying the premises must be managed and not cause a nuisance (including a noise nuisance).


General waste (including the separation of recyclable waste) must be placed in a waste container.


The grounds of the premises are kept in a safe and tidy condition.
